1. Who you are contracting with

This service (the “1954 Act” app, the “Service”) is provided by mcgarrigle & co (“we”, “us”), trading online at mcgarrigle.co.uk. By using the Service you are entering into a contract with mcgarrigle & co. Contact: chris@mcgarrigle.com.

2. Acceptance

By creating an account or continuing to use the Service you agree to these terms. If you do not agree, stop using the Service. If you are using the Service for an organisation, you confirm you have authority to bind that organisation; if you are using it as an individual, you confirm you are of legal age to enter a contract.

3. What the Service is

The Service provides general information and AI-assisted tools relating to Part II of the Landlord and Tenant Act 1954 (England & Wales), including an assistant, action plans, calendar exports, a lease analyser, a Section 25 analyser, Section 26 drafting help and translation features.

The Service is not legal advice and does not create a solicitor–client or surveyor–client relationship. Deadlines under the 1954 Act are strict and outcomes depend on facts we cannot verify. You are responsible for checking any output and for taking professional advice before acting.

4. Accuracy of AI output

Outputs are generated in part by AI models and may be incomplete, out of date or incorrect. Outputs are not suitable for reliance in regulated professional matters without independent human review. You are responsible for your prompts, for the content you upload, for verifying outputs, and for having the rights to any document or text you submit.

5. Your account

You must provide accurate information and keep it up to date. You are responsible for keeping your login credentials confidential and for all activity under your account. Access codes (for example course codes) are personal to the issued cohort and must not be shared publicly or resold.

6. Licence and restrictions

We grant you a limited, non-exclusive, non-transferable right to use the Service within the limits of your plan. You must not reverse engineer, resell, redistribute, sublicense or circumvent technical or usage limits of the Service.

7. Acceptable use

  • No unlawful use, and no use to facilitate unlawful activity.
  • No fraud, spam, misrepresentation or impersonation.
  • No infringement of intellectual property or confidentiality rights of others.
  • No interference with the security or integrity of the Service, including malware, probing, penetration testing without consent, or automated scraping.
  • No attempt to generate illegal content, harassment, hate speech, deepfakes or malware, and no attempts to jailbreak or bypass model safeguards.

We may remove or restrict content, filter or refuse outputs, and suspend accounts where we reasonably believe these rules have been broken. If a rights-holder believes content processed through the Service infringes their rights, they can contact chris@mcgarrigle.com for takedown; repeated infringement will lead to account termination.

8. Your content

You keep ownership of the leases, notices and text you upload. You grant us a limited licence to host and process that content solely to provide the Service to you, including passing it to our AI and email providers for that purpose.

9. Our intellectual property

We retain ownership of the Service and all intellectual property in it, including its software, structured reference content, documentation, design and branding. Statutory text and case citations remain subject to their own sources and licences.

10. Plans, payment and billing

Every account includes a limited number of free runs. After that, a paid plan is required: £10 per month (billed monthly), £99 per year (billed annually), or £50 per month for the helpline with a chartered surveyor. Prices are in GBP and shown on our pricing page. Subscriptions renew automatically at the stated frequency until cancelled.

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, applicable taxes, cancellation and refund mechanics are governed by Paddle’s Buyer Terms. See our Refund Policy for how to request a refund. You can cancel a subscription at any time; access continues until the end of the paid period.

11. Service levels

We aim to keep the Service available, but we do not guarantee uninterrupted or error-free performance. Features may change, and maintenance or third-party outages may cause downtime.

12. Suspension and termination

We may suspend or terminate your access for material breach of these terms, non-payment, security or fraud risk, or repeated or serious policy violations. You may stop using the Service and close your account at any time. On termination your licence ends; you may request an export of your content within 30 days, after which it may be deleted.

13. Warranties and liability

To the fullest extent permitted by law we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement. We are not liable for indirect, consequential or special losses, including loss of profits, business, data or goodwill, or for any lost renewal rights or missed statutory deadlines arising from reliance on the Service. Our total aggregate liability is limited to the fees you paid in the 12 months before the claim. Nothing in these terms excludes liability for fraud, death or personal injury caused by negligence, or any liability that cannot be excluded by law.

14. Indemnity

You will indemnify us against claims, losses and reasonable costs arising from content you submit, your unlawful use of the Service, or your breach of these terms.

15. General

These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction. You may not assign these terms without our consent; we may assign them as part of a merger, acquisition or reorganisation. Neither party is liable for delay or failure caused by events beyond its reasonable control. If a provision is unenforceable, the rest remains in force. We may update these terms and will change the date above; material changes will be notified in the app or by email.
